关于2017年度全国环境影响评价文件技术复核发现问题及处理意见（第二批）的通报

In order to implement the reform requirements of "delegating power, delegating power, delegating power, and providing services".，Strengthen the guidance of EIA approval business and supervision during and after the event，According to the requirements of the "Notice on Carrying out the Technical Review of the 2017 National Environmental Impact Assessment Documents" (Environmental Impact Assessment Letter [2017] No. 677).，Our ministry organized and completed the second batch of 16 provinces (regions).、Municipal level of ecology and environment departments and other examination and approval departments approved 274 construction project environmental impact report (form) technical review work。Reviewed，It was found that there were major problems in the environmental impact reports (forms) of 16 construction projects。
According to the relevant provisions of the "Measures for the Management of Environmental Impact Assessment Qualifications for Construction Projects" (Order No. 36 of the Ministry of Environmental Protection).，8 EIA agencies (another 4 have been decoupled or cancelled，no longer processed) and 19 EIA Engineers for administrative action。thereinto，The EIA document was ordered to omit the main environmental protection objectives、The three EIA agencies and four EIA engineers were given a deadline of 12 months to rectify the problems such as the lack of major environmental protection measures；5 EIA institutions and 15 EIA engineers were ordered to rectify the EIA documents within a period of 6 months if they had problems such as the analysis of the construction project engineering or the wrong status monitoring data cited by the construction project。Please refer to the attachment for details of the relevant issues and handling opinions。
The rectification period shall be calculated from the date of issuance of this circular，The relevant information shall be recorded in the integrity system of the national EIA agency and the EIA engineer。The EIA agency that is ordered to rectify within a time limit，During the rectification period, the competent departments of ecology and environment at all levels shall not accept applications for examination and approval of the environmental impact reports (forms) prepared by them；After the expiration of the rectification period，The above-mentioned institutions shall submit a report on the rectification situation to our ministry。The EIA engineer who is ordered to rectify within a time limit，During the rectification period, the competent departments of ecology and environment at all levels shall not accept applications for examination and approval of environmental impact reports (forms) prepared by them as the presiding officer and the main compiler。
The above-mentioned institutions and personnel have objections to the handling opinions，You can apply to our department for administrative reconsideration within 60 days from the date of receipt of this circular，An administrative lawsuit may also be filed in accordance with law within 6 months from the date of receipt of this circular。
The competent departments of ecology and environment at all levels shall review and discover major problems that affect the conclusion of examination and approval，Effective measures should be taken to avoid the significant impact of project construction on the environment。
