第一章 总 则
Article 1 为规范建设项目环境保护设施竣工验收的程序和标准，Strengthen the main responsibility of construction units for environmental protection，According to the Regulations on the Management of Environmental Protection of Construction Projects，These measures are formulated。
Article 2 本办法适用于编制环境影响报告书（表）并根据环保法律法规的规定由建设单位实施环境保护设施竣工验收的建设项目以及相关监督管理。
Article 3 建设项目竣工环境保护验收的主要依据包括：
(1) Laws related to environmental protection of construction projects、statute、regulations、Standards and normative documents；
(2) Technical specifications for environmental protection acceptance of construction projects；
(3) The environmental impact report (form) of the construction project and the approval decision of the examination and approval department。
Article 4 建设单位是建设项目竣工环境保护验收的责任主体，shall be in accordance with the procedures and standards set forth in these measures，Organize the acceptance of environmental protection facilities for supporting construction，Preparation of acceptance report，Disclose relevant information，Accept social supervision，Ensure that the environmental protection facilities that need to be built in the construction project are put into operation or used at the same time as the main project，and the acceptance of the content、Conclusions and veracity of the information disclosed、Accuracy and completeness are responsible，There shall be no fraud in the acceptance process。
Environmental protection facilities refer to the devices required to prevent and control environmental pollution and ecological damage and to carry out environmental monitoring、equipment and engineering facilities, etc。
The acceptance report is divided into an acceptance monitoring (investigation) report、Acceptance opinions and other matters that need to be explained。
第二章 验收的程序和内容
Article 5 建设项目竣工后，The construction unit shall be truthfully inspected、monitoring、Record the construction and commissioning of environmental protection facilities of construction projects，Preparation of acceptance monitoring (investigation) report。
Construction projects that mainly emit pollutants，参照《建设项目竣工环境保护验收技术指南 污染影响类》编制验收监测报告；Construction projects that have a major impact on the ecology，按照《建设项目竣工环境保护验收技术规范 生态影响类》编制验收调查报告；Thermal power generation、Petroleum refining、Water conservancy and hydropower、Nuclear and radiation and other construction projects that have issued technical specifications for industry acceptance，Prepare acceptance monitoring reports or acceptance investigation reports in accordance with the acceptance technical specifications of the industry。
The construction unit does not have the ability to prepare the acceptance monitoring (investigation) report，It can be commissioned to a competent technical institution。The construction unit shall be responsible for the conclusion of the acceptance monitoring (investigation) report prepared by the entrusted technical institution。The relationship of rights and obligations between the construction unit and the entrusted technical institution，and the responsibilities of the entrusted technical institutions，It can be agreed in the form of a contract。
Article 6 需要对建设项目配套建设的环境保护设施进行调试的，建设单位应当确保调试期间污染物排放符合国家和地方有关污
染物排放标准和排污许可等相关管理规定。
Environmental protection facilities are not built at the same time as the main project，or should have obtained a pollutant discharge permit but did not do so，The construction unit shall not debug the environmental protection facilities of the construction project。
During commissioning，The construction unit shall monitor the operation of environmental protection facilities and the impact of construction projects on the environment。Acceptance monitoring shall ensure the stability of the commissioning conditions of the main project、It is carried out under the condition that the environmental protection facilities are in normal operation，And truthfully record the actual working conditions during monitoring。The relevant national and local pollutant discharge standards or industry acceptance technical specifications have other provisions on working conditions and production loads，It shall be implemented in accordance with its provisions。The construction unit carries out acceptance monitoring activities，According to their own conditions and abilities，Make use of your own personnel、Premises and equipment are monitored on their own；Monitoring could also be entrusted to other competent monitoring bodies。
Article 7 验收监测（调查）报告编制完成后，The construction unit shall be based on the conclusion of the acceptance monitoring (investigation) report，Check one by one whether there is any unqualified acceptance listed in Article 8 of these measures，Put forward acceptance opinions。There is a problem，The construction unit shall carry out rectification，After the rectification is completed, the acceptance opinions can be put forward。
The acceptance opinions include the basic situation of the project construction、Changes in the project、Implementation of environmental protection facilities、Commissioning effect of environmental protection facilities、The impact of engineering construction on the environment、Acceptance conclusions and follow-up requirements，The acceptance conclusion shall clarify whether the environmental protection facilities of the construction project are qualified for acceptance。
After the experience of environmental protection facilities supporting the construction of the construction project is qualified，The main project can be put into production or use；It has not been accepted or the acceptance is unqualified，It shall not be put into production or use。
Article 8 建设项目环境保护设施存在下列情形之一的，The construction unit shall not put forward the opinion of passing the acceptance：
(1) Failure to build environmental protection facilities in accordance with the requirements of the environmental impact report (form) and the approval decision of the examination and approval department，or the environmental protection facilities cannot be put into operation or used at the same time as the main project；
(2) The discharge of pollutants does not comply with relevant national and local standards、The environmental impact report (form) and the approval decision of its examination and approval department or the total discharge control index of key pollutants are required；
(3) After the environmental impact report (form) is approved，The nature of the construction project、scale、place、The production process used or the prevention and control of pollution、There has been a major change in measures to prevent ecological damage，The construction unit has not re-submitted the environmental impact report (form) for approval or the environmental impact report (form) has not been approved；
(4) Major environmental pollution caused during the construction process has not been completed，or causing major ecological damage that has not been restored；
(5) Construction projects included in the management of pollutant discharge permits，Discharging pollutants without a permit or discharging pollutants without a permit；
(6) Phased construction、Construction projects that are put into production or used in phases and shall be accepted in phases in accordance with law，Its phased construction、The ability of environmental protection facilities put into production or use in phases to prevent and control environmental pollution and ecological damage cannot meet the needs of the corresponding main project；
(7) The construction unit is punished for violating national and local environmental protection laws and regulations for the construction project，Ordered to make corrections，The correction has not been completed；
(8) The basic data of the acceptance report are obviously untrue，There are significant deficiencies in the content、omit，Or the acceptance conclusion is not clear、irrational；
(9) Other environmental protection laws, regulations, rules, and other provisions must not pass environmental protection acceptance。
Article 9 为提高验收的有效性，In the process of putting forward acceptance opinions，The construction unit may organize the establishment of an acceptance working group，Take an on-site inspection、Access to information、Convening acceptance meetings, etc，Assist in carrying out acceptance work。Acceptance of the working group can be made up of design units、Construction unit、The organization that prepares the environmental impact report (form).、Acceptance, monitoring (investigation) report preparation agency and other unit representatives, as well as professional and technical experts，The scope and number of delegates are self-determined。
Article 10 建设单位在“其他需要说明的事项”中应当如实记载环境保护设施设计、A brief overview of the construction and acceptance process、The implementation of environmental protection countermeasures other than environmental protection facilities proposed in the environmental impact report (form) and the approval decision of the examination and approval department，and the rectification work。
The relevant local government or government department promises to be responsible for the relocation of residents within the protective distance supporting the construction of the project、Functional replacement、Habitat protection and other environmental protection countermeasures，The construction unit shall actively cooperate with the local government or department to complete the project within the promised time limit，and truthfully record the implementation of the aforesaid environmental protection countermeasures in "other matters that need to be explained".。
Article 11 除按照国家需要保密的情形外，建设单位应当通过其网站或其他便于公众知晓的方式，向社会公开下列信息：
（一）建设项目配套建设的环境保护设施竣工后，公开竣工日期；
（二）对建设项目配套建设的环境保护设施进行调试前，公开调试的起止日期；
（三）验收报告编制完成后5个工作日内，公开验收报告，公示的期限不得少于20个工作日。
建设单位公开上述信息的同时，应当向所在地县级以上环境保护主管部门报送相关信息，并接受监督检查。
Article 12 除需要取得排污许可证的水和大气污染防治设施外，其他环境保护设施的验收期限一般不超过3个月；需要对该类环境保护设施进行调试或者整改的，验收期限可以适当延期，但最长不超过12个月。
验收期限是指自建设项目环境保护设施竣工之日起至建设单位向社会公开验收报告之日止的时间。
Article 13 验收报告公示期满后5个工作日内，建设单位应当登录全国建设项目竣工环境保护验收信息平台，填报建设项目基本信息、环境保护设施验收情况等相关信息，环境保护主管部门对上述信息予以公开。 建设单位应当将验收报告以及其他档案资料存档备查。
Article 14 纳入排污许可管理的建设项目，排污单位应当在项目产生实际污染物排放之前，按照国家排污许可有关管理规定要求，申请排污许可证，不得无证排污或不按证排污。建设项目验收报告中与污染物排放相关的主要内容应当纳入该项目验收完成当年排污许可证执行年报。
第三章 Supervision and inspection
Article 15 各级环境保护主管部门应当按照《建设项目环境保护事中事后监督管理办法（试行）》等规定，通过“双随机一公开”抽查制度，强化建设项目环境保护事中事后监督管理。要充分依托建设项目竣工环境保护验收信息平台，采取随机抽取检查对象和随机选派执法检查人员的方式，同时结合重点建设项目定点检查，The implementation of the "three simultaneities" of environmental protection facilities for construction projects、竣工验收等情况进行监督性检查，监督结果向社会公开。
Article 16 Environmental protection facilities that need to be built have not been completed、It has not been accepted or the experience is unqualified，建设项目已投入生产或者使用的，或者在验收中弄虚作假的，或者建设单位未依法向社会公开验收报告的，县级以上环境保护主管部门应当依照《建设项目环境保护管理条例》的规定予以处罚，并将建设项目有关环境违法信息及时记入诚信档案，及时向社会公开违法者名单。
Article 17 相关地方政府或者政府部门承诺负责实施的环境保护对策措施未按时完成的，环境保护主管部门可以依照法律法规和有关规定采取约谈、综合督查等方式督促相关政府或者政府部门抓紧实施。
第四章 attach 则
Article 18 本办法自发布之日起施行。
